PRIMEI DECIZIE DE SECȚIUNE Cererea nr. 12550/20 I.A împotriva Greciei Curții Europene a Drepturilor Omului (prima secțiune), care așezează la 20 octombrie 2022 ca comitet al comitetului compus din: Krzysztof Wojtyczek , președintele Erik Wennerström, Lorraine Schembri Orland , judecători și Viktoriya Maradudina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 10 martie 2020, Având în vedere decizia de a acorda reclamantului anonimat în temeiul articolului 47 § 4 din Regulamentul de procedură, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIU Reclamantul, dl I. A., s-a născut în 2005. El a fost reprezentat de dna Georgiou, avocat practicant la Atena. La 2 iunie 2021, reclamantul a informat Registrul că a vrut să retragă cererea la Curte.

Având în vedere cele de mai sus, Curtea concluzionează că reclamantul nu poate fi considerat ca fiind nu mai doresc să urmărească cererea (articolul (a) din Convenție). În plus, în conformitate cu articolul în amendă , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cererii. În consecință, cazul ar trebui eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată aplicarea din lista cazurilor sale. DECISION Application no. 12850/20 I.A. against Greece The European Court of Human Rights (First Section), sitting on 20 October 2022 as a Committee composed of: Krzysztof Wojtyczek , President , Erik Wennerström, Lorraine Schembri Orland , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above application lodged on 10 March 2020, Having regard to the decision to grant the applicant anonymity under Rule 47 § 4 of the Rules of Court, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr I. A., was born in 2005. He was represented by Ms N. Georgiou , a lawyer practising in Athens. The applicant’s complaints under Article 3 of the Convention concerning the inhuman or degrading treatment were communicated to the Greek Government (“the Government”). On 2 June 2021 the applicant informed the Registry that he wanted to withdraw the application to the Court. THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 10 November 2022. Viktoriya Maradudina Krzysztof Wojtyczek Acting Deputy Registrar President
