Decizia nr. 2956/20 Olga Eduardovna VAGNER împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 24 noiembrie 2022 în calitate de comitet compus din: Darian Pavli , Președintele Ioannis Ktistakis, Andreas Zünd , judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 28 decembrie 2019, După deliberare, decide după cum urmează: FACTE ȘI PROCEDIMENTE Reclamantul, Olga Eduardovna Vagner, s-a născut în 1967. Ea a fost reprezentată de dna N. Vunder, un avocat practicant la Moscova. Plângerile reclamantului în temeiul articolului 8 din Convenție privind drepturile de contact pentru copii după dizolvarea unui parteneriat cu același sex au fost comunicate guvernului rus care a prezentat observații cu privire la admisibilitatea și meritul. Observațiile au fost transmise reclamantului care a fost invitat să-și prezinte propriile observații. Nu s-a primit niciun răspuns la scrisoarea Registrului. Prin scrisoarea din 14 decembrie 2021, trimisă prin post înregistrat și prin e-mail, reclamantul a fost notificat că perioada autorizată pentru prezentarea observațiilor sale s-a expirat la 3 decembrie 2021 și că nu s-a solicitat prelungirea timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să continue cererea. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE
The applicant, Ms Olga Eduardovna Vagner, was born in 1967. She was represented by Ms N. Vunder, a lawyer practising in Moscow.
The applicant’s complaints under Article 8 of the Convention concerning child contact rights after the dissolution a of same-sex partnership were communicated to the Russian Government which submitted observations on the admissibility and merits. The observations were forwarded to the applicant who was invited to submit her own observations. No reply was received to the Registry’s letter.
By letter dated 14 December 2021, sent by registered post and by email, the applicant was notified that the period allowed for submission of her observations
had expired on 3 December 2021 and that no extension of time had been requested. The applicant’s attention was drawn to Article
37
§

(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. According to the Russian Post Tracking System, after an unsuccessful delivery attempt, the letter was returned to the Court.
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article
37
§
1
(a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
