Decizia nr. 2879/19 Tszyun TSAY împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 5 mai 2022 în calitate de comitet compus din: Darian Pavli, președinte, Andreas Zünd, Mikhail Lobov, judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 3 ianuarie 2019, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl Tszyun Tsay s-a născut în 1975. El a fost reprezentat de dl V.L. Sapozhnikov, avocat practicant la Moscova. Plaga reclamantului în temeiul articolului 8 din Convenție privind ordinea de excludere a duratei nelimitate pentru o singură infracțiune administrativă comisă de el a fost comunicată guvernului rus („ Guvernului”), care a prezentat observații cu privire la admisibilitatea și meritul. Observațiile au fost transmise reprezentantului reclamantului, care a fost invitat să prezinte observații în numele reclamantului. Niciun răspuns nu a fost primit la scrisoarea Registrului. Prin scrisoarea din 21 septembrie 2021, trimisă prin post înregistrat, reprezentantul reclamantului a fost notificat că perioada autorizată pentru prezentarea observațiilor a expirat la 18 august 2021 și că nu a fost solicitată prelungire a timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să continue cererea. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE
The applicant, Mr Tszyun Tsay, was born in 1975. He was represented by Mr
V.L. Sapozhnikov
, a lawyer practising in Moscow.
The applicant’s complaint under Article 8 of the Convention concerning the exclusion order of unlimited duration for a single administrative offence committed by him was communicated to the Russian Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant’s representative, who was invited to submit observations on behalf of the applicant. No reply was received to the Registry’s letter.
By letter dated 21 September 2021, sent by registered post, the applicant’s representative was notified that the period allowed for submission of observations had expired on 18 August 2021 and that no extension of time had been requested. The applicant’s attention was drawn to Article

(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicant’s representative did not claim the letter at the post office, and it was returned to the Court.
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article
37
§
1
(a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
