Decizia nr. 45337/20 A.K. și A.S. împotriva Greciei (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 2 februarie 2023 în calitate de comitet compus din: Darian Pavli , Președintele Ioannis Ktistakis, Andreas Zünd , judecători și Viktoriya Maradudina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 14 octombrie 2020, Având în vedere măsura intermediară indicată guvernului contestat în temeiul articolului 39 din Regulamentul Curții, având în vedere decizia de a acorda reclamanților anonimato în temeiul articolului 47 § 4 din Regulamentul Curții, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților este consemnată în apendice.

Reclamanții au fost reprezentați de doamna I. Metton, un avocat practicant la Paris. La 16 octombrie 2020, Curtea a aderat la cererea reclamanților de a aplica art. 39 din Regulamentul Curții și a solicitat Guvernului să garanteze condițiile de viață ale reclamanților compatibile cu art. 3 din convenție, având în vedere starea lor de sănătate și să furnizeze reclamanților asistență medicală adecvată compatibile cu starea lor de sănătate. În temeiul articolului 3 și/sau al articolului 8 și al articolului 13 din Convenție privind condițiile de viață în afara pădurilor din afara lui Samos, precum și plângerile lor privind lipsa unui remediu eficace în dreptul intern, au fost comunicate guvernului grec („Guvernul”), care a prezentat observații cu privire la admisibilitatea și meritul.

Observațiile au fost transmise reclamanților, care au fost invitați să își prezinte propriile observații. Nu s-a primit niciun răspuns scrisoarea Registrului. Prin scrisoarea din 5 iulie 2022, trimis reprezentantului reclamanților prin intermediul Serviciului de Comunicare Electronic al Curții (eComms), acestea au fost notificate că perioada autorizată pentru prezentarea observațiilor lor S-a expirat la 16 iunie 2022 și nu s-a solicitat prelungirea termenului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea. Avocatul reclamantului a primit această scrisoare în aceeași zi, 5 iulie 2022. Cu toate acestea, nu a urmat niciun răspuns.

Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Prin urmare, este de asemenea necesar să se întrerupă aplicarea articolului 39 din Regulamentul de procedură. Din aceste motive, Curtea, în unanimitate, decide să elimine cererea din lista sa de cazuri. Realizată în limba engleză și notificată în scris la 2 martie 2023. DECISION Application no. 45337/20 A.K. and A.S. against Greece (see appended table) The European Court of Human Rights (Third Section), sitting on 2 February 2023 as a Committee composed of: Darian Pavli , President , Ioannis Ktistakis, Andreas Zünd , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above application lodged on 14 October 2020, Having regard to the interim measure indicated to the respondent Government under Rule 39 of the Rules of Court, Having regard to the decision to grant the applicants anonymity under Rule 47 § 4 of the Rules of Court, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix. The applicants were represented by Ms I. Metton, a lawyer practising in Paris. On 16 October 2020 the Court acceded to the applicants’ request to apply Rule 39 of the Rules of Court and indicated to the Government to guarantee to the applicants’ living conditions compatible with Article 3 of the Convention, having regard to their state of health and to provide the applicants with adequate healthcare compatible with their state of health. The applicants’ complaints under Article 3 and/or Article 8 and under Article 13 of the Convention concerning the living conditions in the forest outside Samos “hotspot”, as well as their complaints about the lack of any effective remedy in domestic law, were communicated to the Greek Government (“the Government”), who submitted observations on the admissibility and merits.

The observations were forwarded to the applicants, who were invited to submit their own observations. No reply was received to the Registry’s letter. By letter dated 5 July 2022, sent to the applicants’ representative via the Court’s Electronic Communication Service (eComms), they were notified that the period allowed for submission of their observations had expired on 16 June 2022 and that no extension of time had been requested. The applicant party’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application.

The applicants’ lawyer received that letter on the same day, 5 July 2022. However, no response has followed. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Accordingly, the case should be struck out of the list. It is therefore also appropriate to discontinue the application of Rule 39 of the Rules of Court. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
