Ismayilova împotriva Azerbaidjanului

Primă secțiune decizia nr. 22182/19 și 39605/20 Kifayat ISMAYILOVA împotriva Azerbaidjanului Curtea Europeană a Drepturilor Omului (prima secțiune), care a stat la 27 iunie 2024 în calitate de comitet compus din: Péter Paczolay , Președintele Gilberto Felici , Raffaele Sabato , judecători și Viktoriya Maradudina, grefierul adjunct al secțiunii interioare; Având în vedere cererile depuse la 10 aprilie 2019 și, respectiv, 13 august 2020, având deliberat, hotărăște după cum urmează: FACTE ȘI PROCEDIU Reclamantul, dna Kifayat Hasan Gizi Ismayilova, s-a născut în 1951. A fost reprezentată de U. Maharramova, un avocat cu sediul în Azerbaidjan. Plângerile reclamantului în temeiul articolului 6 § 1 și al articolului 13 din Convenția și al articolului 1 din Protocolul nr. 1 la Convenția privind confiscarea proprietăților ei nerezidențiale în cadrul procedurii penale împotriva ginerului ei au fost comunicate guvernului azerbaigian („Guvernul”).

Prin o scrisoare din 29 de ani. Avril 2024, reclamantul a informat Registrul că dorește să își retragă cererile la Curte în calitate de ordin de confiscare în ceea ce privește proprietatea a fost eliminată și chestiunea a fost astfel rezolvată. HOTĂRÂREA având în vedere faptul că cererile au fost depuse de același reclamant, Curtea consideră oportun să le examineze în comun într-o singură decizie. Având în vedere cele de mai sus, Curtea concluzionează că reclamantul poate fi considerat nu mai doresc să urmărească cererile [articolul (a) din Convenție]. În plus, în conformitate cu articolul în amendă , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cererilor.

În consecință, cauzele ar trebui eliminate din listă. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor, hotărăște să scoată cererile din lista cazurilor sale. Adoptat în limba engleză și notificat în scris la 18 iulie 2024. Viktoriya Maradodina Péter Paczolay Presiden

FACTS AND PROCEDURE

The applicant, Ms Kifayat Hasan gizi Ismayilova, was born in 1951. She was represented by U. Maharramova, a lawyer based in Azerbaijan. The applicant’s complaints under Article 6 § 1 and Article 13 of the Convention and Article 1 of Protocol No. 1 to the Convention concerning the confiscation of her non-residential property in the framework of the criminal proceedings against her son-in-law were communicated to the Azerbaijani Government (“the Government”). By a letter of 29 April 2024, the applicant informed the Registry that she wanted to withdraw her applications to the Court as the confiscation order in respect of the property had been lifted and the matter had thus been resolved. THE LAW Having regard to the fact that the applications were lodged by the same applicant, the Court finds it appropriate to examine them jointly in a single decision.

In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the applications (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications. Accordingly, the cases should be struck out of the list. For these reasons, the Court, unanimously, Decides to join the applications, Decides to strike the applications out of its list of cases.
