CUARTA DECIZIE A SECȚIEI nr. 11093/23 Vladica LAPČEVI în fața Serbiei și a altor 7 cereri (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (a patra secțiune), care a stat la 5 septembrie 2024 în calitate de comitet compus din: Anne Louise Bormann , Președintele Branko Lubarda , Sebastian Rădulețu , judecători și Viktoriya Maradodina , grefier adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazurilor, după deliberare, hotărăsc după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților și reprezentanților acestora este prezentată în tabelul adăugat.
În conformitate cu art. 6 § 1 din Convenția și cu art. 1 din Protocolul nr. 1 privind neexecuția deciziilor interne adoptate împotriva societăților deținute social/de stat au fost comunicate guvernului sârb („ Guvernul”). Curtea a primit declarațiile prietenoase, semnate de părți, în temeiul cărora reclamanții au convenit să renunțe la orice nouă afirmații împotriva Serbiei în ceea ce privește faptele care dau naștere la aceste cereri, sub rezerva unei angajamente ale Guvernului de a le plăti sumele detaliate în tabelul anexat. Aceste sume vor fi convertite în moneda statului interesat la rata aplicabilă la data plății și vor fi plătite în termen de trei luni de la data notificării hotărârii Curții.
În cazul în care aceste sume nu se plătesc în termenul de trei luni menționat anterior, guvernul se angajează să le plătească dobânzi simple, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de creditare a Băncii Centrale Europene în timpul perioadei de incumprire plus trei puncte procentuale. Guvernul se angajează, de asemenea, să asigure executarea deciziilor interne în cauză (a se vedea tabelul adăugat) în aceeași perioadă de trei luni și să plătească orice costuri ale procedurii interne de aplicare. Plata și executarea deciziilor interne în cazurile în cauză vor constitui rezoluția finală a cazurilor. Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie.
Curtea ia act de soluționarea prietenoasă achiziționată între părți. Este satisfăcut că soluționarea se bazează pe respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, și nu găsește motive pentru a justifica examinarea continuă a cererilor. Având în vedere cele de mai sus, este necesar să se scoată cazurile din listă. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; decide să scoată cererile din lista sa de cazuri în conformitate cu art. 39 din Convenție.

DECISION Application no. 11093/23 Vladica LAPČEVIĆ against Serbia and 7 other applications (see appended table) The European Court of Human Rights (Fourth Section), sitting on 5 September 2024 as a Committee composed of: Anne Louise Bormann , President , Branko Lubarda, Sebastian Rădulețu , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above applications lodged on the various dates indicated in the appended table, Having regard to the formal declarations accepting a friendly settlement of the cases, Having deliberated, decides as follows:
The list of applicants and their representatives is set out in the appended table. The applicants’ complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 concerning the non-enforcement of domestic decisions given against socially/State-owned companies were communicated to the Serbian Government (“the Government”). The Court received the friendly-settlement declarations, signed by the parties, under which the applicants agreed to waive any further claims against Serbia in respect of the facts giving rise to these applications, subject to an undertaking by the Government to pay them the amounts detailed in the appended table. These amounts will be converted into the currency of the respondent State at the rate applicable on the date of payment, and will be payable within three months from the date of notification of the Court’s decision.
In the event of failure to pay these amounts within the above-mentioned three-month period, the Government undertake to pay simple interest on them, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The Government also undertake to ensure the enforcement of the domestic decisions under consideration in the cases concerned (see appended table) within the same three-month period, and to pay any costs of the domestic enforcement proceedings. The payment and the enforcement of the domestic decisions in the cases concerned will constitute the final resolution of the cases.
THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify a continued examination of the applications. In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases in accordance with Article 39 of the Convention.
