DECIZIA nr. 53261/12 Milena POPOVI împotrivă Serbiei și alte 18 cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (A treia secțiune), ședința la 27 mai 2014 în calitate de comitet compus din: Ján Šikuta, președinte, Dragoljub Popović, Iulia Antoanella Motoc, judecători și Marialena Tsirli, grefier adjunct al secțiunii; Având în vedere cererile depuse mai sus între 13 august 2012 și 14 iunie 2013, având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazurilor, după deliberare, hotărăsc după cum urmează: FACTE ȘI PROCEDURĂ În tabelul adăugat se prezintă detaliile personale și relevante ale reclamanților. Guvernul sârb ("Guvernul") a fost reprezentat de agentul lor, dna V. Rodić.

În baza diverselor articole ale Convenției, reclamanții se plângeau de neîndeplinirea hotărârilor finale ale statului interesat în favoarea lor împotriva societăților deținute social/de stat. Informațiile esențiale privind procedurile interne în ceea ce privește fiecare cerere sunt indicate în tabelul adăugat. Între 20 septembrie 2013 și 9 ianuarie 2014, Curtea a primit declarații de decontare prietenoase semnate de părțile în temeiul cărora reclamanții au convenit să renunțe la orice nouă reclamație împotriva Serbiei în ceea ce privește faptele care dau naștere la aceste cereri împotriva unei întreprinderi ale Guvernului de a plăti fiecare dintre acestea 2.000 EUR (2,000 EUR) pentru a acoperi orice prejudiciu moral, precum și costurile și cheltuielile, care ar fi convertite în monedă locală la rata aplicabilă la data plății, și ar fi eliberate de orice impozită care ar putea fi aplicabilă.

Aceste sume vor fi plătite în termen de trei luni de la data notificării hotărârii luate de Curte. În cazul în care aceste sume nu au fost plătite în termenul de trei luni, guvernul s-a angajat să le plătească dobânzi simple, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de împrumut a Băncii Centrale Europene în timpul perioadei implicite plus trei puncte procentuale. Părțile, de asemenea, au convenit că, în termen de trei luni, guvernul va plăti, din fondurile proprii, sumele acordate în deciziile interne luate în considerare în cazurile în cauză (a se vedea tabelul adăugat), mai puțin orice sume care ar fi putut fi deja plătite pe baza deciziilor respective, plus costurile procedurii interne de aplicare.

Aceste plăți vor constitui rezoluția finală a cazurilor pe care le solicită Curtea Europeană a Drepturilor Omului. DREPTUL Curții consideră că, în conformitate cu art. 42 § 1 din Regulamentul Curții, cererile ar trebui să fie însoțite, având în vedere situația lor factuală și juridică similară. Curtea ia act de soluțiile prietenoase atinse între părți. Este convins că soluțiile se bazează pe respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, și nu găsește niciun motiv pentru a justifica examinarea continuă a cererilor. Având în vedere cele de mai sus, este necesar să se scoată din listă cazurile. Din aceste motive, Curtea este în unanimitate Decide să se alăture cererilor; hotărăște să scoată cererile din lista sa de cazuri în conformitate cu art. 39 din Convenție.

DECISION Application no. 53261/12 Milena POPOVIĆ against Serbia and 18 other applications (see list appended) The European Court of Human Rights (Third Section), sitting on 27 May 2014 as a Committee composed of: Ján Šikuta, President, Dragoljub Popović, Iulia Antoanella Motoc, judges, and Marialena Tsirli, Deputy Section Registrar, Having regard to the above applications lodged between 13 August 2012 and 14 June 2013, Having regard to the formal declarations accepting a friendly settlement of the cases, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicants’ personal and other relevant details are set out in the appended table. The Serbian Government ("the Government") were represented by their Agent, Ms V. Rodić. Relying on various Articles of the Convention, the applicants complained about the respondent State’s failure to enforce final court decisions rendered in their favour against socially/State-owned companies. The essential information as to the domestic proceedings in respect of each application is indicated in the appended table.

Between 20 September 2013 and 9 January 2014 the Court received friendly settlement declarations signed by the parties under which the applicants agreed to waive any further claims against Serbia in respect of the facts giving rise to these applications against an undertaking by the Government to pay each of them 2,000 EUR (two thousand euros) to cover any non-pecuniary damage as well as costs and expenses, which would be converted into local currency at the rate applicable on the date of payment, and would be free of any taxes that may be applicable. These sums would be payable within three months from the date of notification of the decision taken by the Court.

In the event of failure to pay these sums within the said three-month period, the Government undertook to pay simple interest on them, from expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The parties, furthermore, agreed that within the said three-month period the Government would pay, from their own funds, the sums awarded in the domestic decisions under consideration in the present cases (see table appended), less any amounts which may have already been paid on the basis of the said decisions, plus the costs of the domestic enforcement proceedings. These payments will constitute the final resolution of the cases pending before the European Court of Human Rights.

THE LAW The Court considers that, in accordance with Rule 42 § 1 of the Rules of Court, the applications should be joined, given their similar factual and legal background. The Court takes note of the friendly settlements reached between the parties. It is satisfied that the settlements are based on respect for human rights as defined in the Convention and its Protocols and finds no reasons to justify a continued examination of the applications. In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court unanimously Decides to join the applications; Decides to strike the applications out of its list of cases in accordance with Article 39 of the Convention.
