CUARTA DECIZIE A SECȚIEI Nr. 28738/19 Călin RUS împotriva României Curtea Europeană a Drepturilor Omului (a patra secțiune), care a stat la 19 decembrie 2024 în calitate de comitet compus din: Anne Louise Bormann , Președintele Sebastian Rădulățu, András Jakab , judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 9 mai 2019, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl Călin Rus s-a născut în 1988. El a fost reprezentat de dl A. Popescu, avocat practicant în Turda. Convenția privind procedurile penale împotriva reclamantului a fost comunicată guvernului român („Guvernul”), care a prezentat observații cu privire la admisibilitatea și meritul. Observațiile au fost transmise reclamantului, care a fost invitat să își prezinte propriile observații. Nu a fost primit niciun răspuns la scrisoarea Registrului. Prin scrisoarea din 16 august 2023, trimisă prin post înregistrat, reclamantul a fost notificat că perioada permisă de prezentare a observațiilor sale s-a expirat la 27 iunie 2023 și că nu s-a solicitat prelungirea timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri. The applicant, Mr Călin Rus, was born in 1988. He was represented by Mr
The applicant’s complaint under Article 6
of the Convention concerning the criminal proceedings against the applicant were communicated to the Romanian Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit his own observations. No reply was received to the Registry’s letter.
By letter dated 16 August 2023, sent by registered post, the applicant was notified that the period allowed for submission of his observations
had expired on 27 June 2023 and that no extension of time had been requested. The applicant’s attention was drawn to Article
37
§
1
(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicant received that letter on 1
September 2023. However, no response has followed.
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article
37
§
1
(a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
