Cazul Data deciziei 34000/12 H.S. 04/06/2013 41208/11 MESSAD ȘI TOUAHRIA 08/10/2013 70055/10 S.J. 19/03/2015 Comitetul de miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor așezări prietenoase așa cum apar în deciziile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că, în aceste cazuri, Curtea a luat notă oficială de așezările prietenoase atinse de Guvernul Statului pârât și de reclamanții și a fost convinsă că așezările s-au bazat pe respectarea drepturilor omului, astfel cum sunt definite în Convenția sau în Protocolul său, a hotărât să pună în aplicare aceste cazuri din lista sa; având în vedere că termenele așezărilor prietenoase au fost executate de Guvernul Statului pârât, DECLARES că a exercitat rolurile sale în temeiul articolului 39 alineatul (4) din Convenția și DECIDES pentru a încheia examinarea acestora.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in these cases the Court, having taken formal note of the friendly settlements reached by the government of the respondent State and the applicants and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided to strike these cases from its list;

Having satisfied itself that the terms of the friendly settlements were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
