Bak împotriva Poloniei și alte 102 cauze

Rezoluția CM/ResDH(2017)426 Execuția hotărârilor Curții Europene a Drepturilor Omului 103 de cazuri împotriva Poloniei (Adoptat de Comitetul de Miniștri la 7 decembrie 2017 la ședința 1302 a Deputaților Miniștrilor) Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere hotărârile finale transmise de Curte Comitetului în aceste cazuri și încălcările stabilite privind durata excesivă a procedurilor civile și penale și lipsa unei soluții eficace în acest sens (violații articolelor 6 și 13), precum și deținerea prealabilă lungă a anumitor solicitanți (violații de la art. 5 § 3); Amintind obligația statului contestat, în temeiul articolului 46 alineatul (1) din convenție, de a respecta toate hotărârile finale în cazurile la care a fost parte și că această obligație presupune, peste și peste plata sumelor atribuite de Curte, adoptarea de către autoritățile statului contestat, dacă este necesar: a măsurilor individuale pentru a pune capăt încălcărilor stabilite și a șterge consecințele acestora, astfel încât să atingă, în măsura posibilului,

restabilirea în integritate și a măsurilor generale de prevenire a încălcărilor similare; după ce a invitat Guvernul Statului pârât să informeze Comitetul cu privire la măsurile luate pentru a respecta obligația menționată anterior; După examinarea planului de acțiune prevăzut de guvern, care indică măsurile individuale adoptate pentru a da efect hotărârilor, inclusiv informațiile furnizate cu privire la plata satisfacției echitabile acordate de Curte (a se vedea documentul DH-DD(2017)1102 Având în vedere faptul că problema măsurilor individuale a fost soluționată pe măsură ce procedurile judiciare interne au ajuns la un sfârșit și/sau autoritățile au adoptat măsuri pentru accelerarea procedurii în curs și că reclamanții a căror detenție preliminară a fost criticată de Curte nu mai sunt reținuți pe acest motiv; Având în vedere faptul că măsurile adoptate pentru a preveni detențiile precauționale excesiv de lungi au fost examinate de către Comitetul în cadrul grupului de cazuri Trzaska și în cazul Matczak (a se vedea Rezoluțiile finale CM/ResDH(2014)268 și CM/ResDH(2017)163 Amintind că problema măsurilor generale necesare pentru a răspunde la deficiențele stabilite de Curte în prezentele hotărâri continuă să fie examinată în contextul Bāk, Majewski,

Resolution CM/ResDH(2017)426 Execution of the judgments of the European Court of Human Rights 103 cases against Poland (Adopted by the Committee of Ministers on 7 December 2017 at the 1302 nd meeting of the Ministers’ Deputies) The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”), Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations established concerning the excessive length of civil and criminal proceedings and the lack of an effective remedy in this respect (violations of Articles 6 and 13), as well as the lengthy pre-trial detention of certain applicants (violations of Article 5 § 3); Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State,

where required: - of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and - of general measures preventing similar violations; Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation; Having examined the action plan provided by the government indicating the individual measures adopted in order to give effect to the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2017)1102 ); Considering that the question of the individual measures has been resolved as the domestic judicial proceedings have come to an end and/or the authorities have adopted measures to accelerate the pending proceedings and that the applicants whose pre-trial detention was criticised by the Court are no longer detained on this ground; Having noted that the measures adopted to prevent excessively lengthy pre-trial detentions have been examined by the Committee in the Trzaska group of cases and in the Matczak case (see Final Resolutions CM/ResDH(2014)268 and CM/ResDH(2017)163 );

Recalling that the question of the general measures required to respond to the shortcomings established by the Court in the present judgments continues to be examined in the context of the Bąk, Majewski, Rutkowski and Załuska cases and that the closure of these judgments is without prejudice in any way to the Committee’s assessment of the general measures necessary to ensure the expeditiousness of civil and criminal proceedings and the effectiveness of the domestic remedy, DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases and DECIDES to close the examination thereof.
