Decizia nr. 13901/15 Murad Khasyanovich LUCMANOV împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 13 septembrie 2018 în calitate de comitet compus din: Alena Poláčková, președinte, Dmitry Dedov, Jolien Schukking, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 10 martie 2015, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl Murad Khasyanovich Lukmanov a fost născut în 1974. El a fost reprezentat în fața Curții de dl I. Vlasov, care rezidă la Moscova. 13 din Convenția privind condițiile de detenție a deținuților cu handicap și lipsa unui remediu eficace în dreptul intern au fost comunicate guvernului rus („Guvernului”), care a prezentat observații cu privire la admisibilitatea și meritul. Prin scrisorile din 28 iulie 2017 și 6 februarie 2018, trimise prin post înregistrat, reprezentantul reclamantului a fost notificat că perioada autorizată pentru prezentarea observațiilor sale a expirat și că nu a fost solicitată prelungire a timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să continue cererea. Cu toate acestea, nu a urmat niciun răspuns. În plus, în conformitate cu articolul din amenzi , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale care necesită examinarea continuă a cererii. Prin urmare, cazul ar trebui eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide pentru a elimina cererea din lista de cazuri. Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Murad Khasyanovich Lukmanov, was born in 1974.
He was represented before the Court by Mr I. Vlasov, residing in Moscow.
The applicant’s complaints under Articles 3 and
13 of the Convention concerning the conditions of detention of disabled inmates and the lack of any effective remedy in domestic law were communicated to the Russian Government (“the Government”), who submitted observations on the admissibility and merits.
By letters dated 28 July 2017 and 6 February 2018, sent by registered post, the applicant’s representative was notified that the period allowed for submission of his observations
had expired and that no extension of time had been requested. His attention was drawn to Article
37
§
1
(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. However, no response has followed.
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article
37
§
1
(a) of the Convention). Furthermore, in accordance with Article
37
§
1
in fine
, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
