CUARTA DECIZIE A SECȚIEI nr. 41142/16 Costin POPOUI împotriva României Curtea Europeană a Drepturilor Omului (a patra secțiune), care așeză la 24 octombrie 2019 în calitate de comitet compus din: Stéphanie Mourou-Vikström, președinte, Georges Ravarani, Jolien Schukking, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 27 septembrie 2016, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE Reclamantul, dl Costin Popoiu, s-a născut în 1985. Plainele reclamantului în temeiul articolului 3 din Convenție privind condițiile inadecvate de detenție au fost comunicate guvernului român („Guvernul”) La 6 septembrie 2019, reclamantul a informat Registrul că a vrut să retragă prezenta cerere, deoarece a beneficiat de remedierea compensatorie internă prevăzută de Legea nr. 169/2017.

HOTĂRÂREA Având în vedere cele de mai sus, Curtea concluzionează că reclamantul poate fi considerat că nu mai dorește să urmărească cererea (articolul În plus, în conformitate cu articolul din amenzi , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale care necesită examinarea continuă a cererii. Prin urmare, cazul ar trebui eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide pentru a elimina cererea din lista de cazuri. FACTS AND PROCEDURE

The applicant, Mr Costin Popoiu, was born in 1985. The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”) On 6 September 2019 the applicant informed the Registry that he wanted to withdraw the present application as he benefitted from the domestic compensatory remedy provided by Law no. 169/2017. THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
