Begović împotriva Croației

Rezoluția CM/ResDH(2019)310 Execuția hotărârii Curții Europene a Drepturilor Omului Begović împotriva Croației (Aprobată de Comitetul de Miniștri la 5 decembrie 2019 la ședința 1362 a Deputaților Miniștrilor) Hotărârea nr. Hotărârea finală la 35810/14 BEGOVIδ 13/06/2019 13/06/2019 Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere hotărârea finală transmisă de Curte Comitetului în acest caz și încălcarea stabilită; Amintind obligația statului contestat, în temeiul articolului 46 alineatul (1) din convenție, de a respecta toate hotărârile finale în cazurile la care a fost parte și că această obligație presupune, peste și peste plata sumelor atribuite de Curte, adoptarea de către autoritățile statului contestat, dacă este necesar: a măsurilor individuale pentru a pune capăt încălcărilor stabilite și a șterge consecințele acestora, astfel încât să atingă, în măsura posibilului, restabilirea în integritate și a măsurilor generale de prevenire a încălcărilor similare; după ce a invitat Guvernul Statului pârât să informeze Comitetul cu privire la măsurile luate pentru a respecta obligația menționată anterior;

După examinarea raportului de acțiune furnizat de guvern, care indică măsurile adoptate pentru a aduce atingere hotărârii și subliniind faptul că Curtea nu a pronunțat în acest caz nicio atribuire justă de satisfacție (a se vedea documentul DH-DD(2019)1271, având în vedere că toate măsurile prevăzute la art. 46 alineatul (1) au fost adoptate, DECLARA că a exercitat funcțiile sale în temeiul articolului 46 alineatul (2) din Convenție în acest caz și DECIDE să încheie examinarea acestora.

Resolution CM/ResDH(2019)310 Execution of the judgment of the European Court of Human Rights Begović against Croatia (Adopted by the Committee of Ministers on 5 December 2019 at the 1362 nd meeting of the Ministers’ Deputies) Application No. Case Judgment of Final on 35810/14 BEGOVIĆ 13/06/2019 13/06/2019 The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”), Having regard to the final judgment transmitted by the Court to the Committee in this case and to the violation established; Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required: - of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and - of general measures preventing similar violations;

Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation; Having examined the action report provided by the government indicating the measures adopted to give effect to the judgment and noting that no award of just satisfaction was made by the Court in the present case (see document DH-DD(2019)1271 ); Having satisfied itself that all the measures required by Article 46, paragraph 1, have been adopted, DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in this case and DECIDES to close the examination thereof.
