Caz Data hotărârii 59222/18 Tatyana Borisovna OKUSHKO ȘI ALȚI 17/12/2020 Comitetul de miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase, astfel cum apar în hotărârile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), Având în vedere faptul că, în acest caz, Curtea, după ce a luat notă oficială de soluționare prietenoasă atinsă de Guvernul Statului pârât și de reclamant, și având în vedere că soluționarea s-a bazat pe respectarea drepturilor omului, astfel cum este definită în Convenția sau în Protocolurile sale, a hotărât să atace acest caz din lista sa; Având în vedere faptul că termenii de soluționare prietenoasă au fost executați de Guvernul Statului pârât (a se vedea documentul DH-DD(2025)32 DECLARES că și-a exercitat funcțiile în temeiul articolului 39 alineatul (4) din Convenție și DECIDE pentru a încheia examinarea acestuia.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of friendly settlement reached by the government of the respondent state and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided, to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State (see document

DH-DD(2025)32

);

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
