(2) din Convenția pentru Protecția Drepturilor Omului și a Libertăților Fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că, în acest caz, Curtea, după a luat act oficial de soluționarea prietenoasă atinsă de Guvernul Statului pârât și de reclamant, și având în vedere că soluționarea s-a bazat pe respectarea drepturilor omului, astfel cum este definită în Convenția sau în protocolele sale, a hotărât să încheie acest caz din lista sa; având în vedere că termenii soluționării prietenoase au fost executați de Guvernul Statului pârât, DECLARES că a exercitat funcțiile sale în temeiul art. 46 alin. (2) din Convenția și DECIDES să încheie examinarea sa.

The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention and

DECIDES to close its examination.
