A cincea secțiune DECIZIE nr. 54217/14 Valeriy Viktorovych KOT împotriva Ucrainei Curții Europene a Drepturilor Omului (A Cincea Secțiune), care așeză la 26 august 2021 ca comitet compus din: Stéphanie Mourou-Vikström, președinte, Jovan Ilievski, Mattias Guyomar, judecători și Viktoriya Maradodina, grefier interimar, având în vedere cererea depusă la 24 iulie 2014, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl Valeriy Viktorovych Kot, care s-a născut în 1955. El s-a plâns de o lungă neexecuție a hotărârii din 24 martie 2011 în favoarea sa. Prin scrisoarea din 16 februarie 2021, trimisă de post înregistrat, reclamantul a fost solicitat să furnizeze câteva informații cu privire la procedura internă.

(a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea. Reclamantul a primit această scrisoare la 12 martie 2021. Cu toate acestea, nu a urmat niciun răspuns. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri.

FACTS AND PROCEDURE

The applicant, Mr Valeriy Viktorovych Kot, was born in 1955. He complained about lengthy non-enforcement of the judgment of 24 March 2011 in his favour. By letter dated 16 February 2021, sent by registered post, the applicant was requested to provide some information about the domestic proceedings. His attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicant received this letter on 12 March 2021. However, no response has followed. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
