Cererea nr. 24215/18 Rustem Firkatovich SALIMZYANOV împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 7 octombrie 2021 în calitate de comitet al comitetului compus din: Peeter Roosma, Președinte, Dmitry Dedov, Andreas Zünd, judecători și Viktoriya Maradudina, grefier interimar, având în vedere cererea depusă la 12 aprilie 2018, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl Rustem Firkatovich Salimzyanov s-a născut în 1970. El a fost reprezentat de dna A.V. Kondratyeva, avocat practicant în Kanash. Plângerile reclamantului în temeiul articolului 6 §§ § 1 și al treilea paragraf al Convenției privind incapacitatea de a contesta dovezile de experți introduse de probă au fost comunicate guvernului rus („Guvernul”), care a prezentat observații cu privire la admisibilitatea și meritul. Observațiile au fost transmise reclamantului, care a fost invitat să-și prezinte propriile observații. Prin scrisoarea din 24 martie 2021, trimisă de postul înregistrat, reclamantul a fost notificat că perioada permisă pentru prezentarea observațiilor sale a expirat la 11 martie 2021 și că nu a fost solicitată prelungirea timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista de cauze. FACTS AND PROCEDURE
The applicant, Mr Rustem Firkatovich Salimzyanov, was born in 1970. He was represented by Ms A.V. Kondratyeva, a lawyer practising in Kanash.
The applicant’s complaints under Article 6 §§ 1 and 3 (d) of the Convention concerning inability to challenge expert evidence introduced by the prosecution were communicated to the Russian Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit his own observations. No reply was received to the Registry’s letter.
By letter dated 24 March 2021, sent by registered post, the applicant was notified that the period allowed for submission of his observations had expired on 11 March 2021 and that no extension of time had been requested. The applicant’s attention was drawn to Article
37
§
1
(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicant received that letter on 13
April 2021. However, no response followed.
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article
37
§
1
(a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
