DECIZIE DE DECIZIE Nr. 31275/24 Károly MONOKI și alții împotriva Ungariei (a se vedea tabelul adăugat) Curtea Europeană a Drepturilor Omului (A doua secțiune), care a stat la 5 februarie 2026 în calitate de comitet compus din: Stéphane Pisani , Președintele, Juha Lavapuro, Hugh Mercer , judecători și Attila Teplán, grefierul adjunct al secțiunii interioare, având în vedere cererea de mai sus împotriva Ungariei depusă în temeiul articolului 34 din Convenția pentru protecția drepturilor Omului și libertăților fundamentale („Convenția”) la 21 octombrie 2024, având în vedere declarația depusă de Guvernul reclamant care solicită Curtea să elimine aplicarea din lista cazurilor, Hotărând deliberat, hotărârea după cum urmează: FACTS ȘI PROCEDICU . Solicitanţii au fost reprezentaţi de dl I. Barbalici, un avocat practicant în Budapesta.
În temeiul articolului 6 § 1 din Convenție, reclamațiile solicitanților privind durata excesivă a procedurilor civile au fost comunicate guvernului maghiar („Guvernului”). Plainele bazate pe aceleași fapte au fost comunicate, de asemenea, în temeiul altor dispoziții ale Convenției. DREPTUL După negocierile încheiate fără succes, Guvernul a informat Curtea că au propus să facă declarații unilaterale în vederea soluționării problemelor legate de aceste plângeri. Acestea au solicitat în continuare Curtea să elimine cererea în conformitate cu art. 37 din Convenție. Guvernul a recunoscut durata excesivă a procedurilor civile. În plus, ei au recunoscut că autorităţile interne au încălcat drepturile solicitanţilor garantate de alte dispoziţii ale Convenției.
Acestea au oferit solicitanților să plătească suma detaliată în tabelul adăugat și au invitat Curtea să elimine cererea din lista cazurilor în conformitate cu art. 37 alineatul (1) litera (c) din convenție. Suma ar fi convertită în moneda statului interesat la rata aplicabilă la data plății și ar fi plătită în termen de trei luni de la data notificării hotărârii Curții. În cazul în care nu s-a plătit această sumă în termenul de trei luni menţionat mai sus, guvernul s-a angajat să plătească dobânzi simple pe aceasta, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de creditare a Băncii Centrale Europene în timpul perioadei implicite plus trei puncte procentuale.
Plata va constitui rezoluția finală a cazului. Solicitanții au fost trimise termenii declarației unilaterale ale Guvernului cu câteva săptămâni înainte de data prezentei decizii. Curtea nu a primit niciun răspuns din partea solicitanților care acceptă termenii declarației. Curtea remarcă că art. 37 alineatul (1) litera (c) îi permite să ia un caz din lista sa dacă: „... pentru orice alt motiv stabilit de Curte, nu mai este justificat continuarea examinării cererii”. Astfel, aceasta poate elimina cererile în temeiul articolului 37 alineatul (1) litera (c) pe baza unei declarații unilaterale de către un guvern contestat, chiar dacă reclamanții doresc să continue examinarea cazului (a se vedea, în special, Tahsin Acar v. Hotărârea Turciei (obiecții preliminare) [GC], nr. 26307/95, §§ 75-77, CEDO 2003-VI).
Curtea a stabilit o jurisprudență clară și extinsă privind plângerile referitoare la lungimea excesivă a procedurilor civile (a se vedea, de exemplu, Gazsó v. Ungaria, nr. 48322/12, 16 iulie 2015 și Csatári și alții c. Ungaria [Comitet], nr. 18514/24, 20 mai 2025). Remarcarea admiterilor conținute în declarația Guvernului, precum și cuantumul compensației propuse – care este în conformitate cu sumele acordate în cazuri similare – consideră că nu mai este justificat continuarea examinării cererii (art. 37 § 1 litera (c)). Având în vedere considerentele de mai sus, Curtea este convinsă că respectarea drepturilor omului, astfel cum este definită în Convenție și în Protocolurile acestuia, nu impune să continue examinarea cererii (art. 37 § 1 în amendă ). În sfârșit, Curtea subliniază că, în cazul în care guvernul nu respectă termenii declarației lor unilaterale, cererea poate fi restaurată pe listă în conformitate cu art. 37 alineatul (2) din Convenție (Josipović v. Serbia (dec.), nr. 18369/07, 4 martie 2008). Având în vedere cele de mai sus, este necesar să se scoată cazul din listă.
Din aceste motive, Curtea ia act, în unanimitate, de termenele declarației guvernului contestat și de modalitățile de asigurare a respectării întreprinderilor menționate în acest articol; decide să scoată aplicarea din lista sa de cazuri în conformitate cu art. 37 § 1 litera (c) din convenție.

The list of applicants is set out in the appended table. The applicants were represented by Mr I. Barbalics, a lawyer practising in Budapest. The applicants’ complaints under Article 6 § 1 of the Convention concerning the excessive length of civil proceedings were communicated to the Hungarian Government (“the Government”). Complaints based on the same facts were also communicated under other provisions of the Convention. THE LAW After unsuccessful friendly-settlement negotiations, the Government informed the Court that they proposed to make unilateral declaration with a view to resolving the issues raised by these complaints. They further requested the Court to strike out the application in accordance with Article 37 of the Convention.
The Government acknowledged the excessive length of civil proceedings. They further acknowledged that the domestic authorities had violated the applicants’ rights guaranteed by other provisions of the Convention. They offered to pay the applicants the amount detailed in the appended table and invited the Court to strike the application out of the list of cases in accordance with Article 37 § 1 (c) of the Convention. The amount would be converted into the currency of the respondent State at the rate applicable on the date of payment, and would be payable within three months from the date of notification of the Court’s decision. In the event of failure to pay this amount within the above-mentioned three-month period, the Government undertook to pay simple interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.
The payment will constitute the final resolution of the case. The applicants were sent the terms of the Government’s unilateral declaration several weeks before the date of this decision. The Court has not received a response from the applicants accepting the terms of the declaration. The Court observes that Article 37 § 1 (c) enables it to strike a case out of its list if: “... for any other reason established by the Court, it is no longer justified to continue the examination of the application”. Thus, it may strike out applications under Article 37 § 1 (c) on the basis of a unilateral declaration by a respondent Government even if the applicants wish the examination of the case to be continued (see, in particular, the Tahsin Acar v. Turkey judgment (preliminary objections) [GC], no. 26307/95, §§ 75 ‑ 77, ECHR 2003-VI).
The Court has established clear and extensive case-law concerning complaints relating to the excessive length of civil proceedings (see, for example, Gazsó v. Hungary, no. 48322/12, 16 July 2015 and Csatári and Others v. Hungary [Committee], no. 18514/24, 20 May 2025). Noting the admissions contained in the Government’s declaration as well as the amount of compensation proposed – which is consistent with the amounts awarded in similar cases – the Court considers that it is no longer justified to continue the examination of the application (Article 37 § 1 (c)). In the light of the above considerations, the Court is satisfied that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application (Article 37 § 1 in fine ). Finally, the Court emphasises that, should the Government fail to comply with the terms of their unilateral declaration, the application may be restored to the list in accordance with Article 37 § 2 of the Convention ( Josipović v. Serbia (dec.), no. 18369/07, 4 March 2008). In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court, unanimously, Takes note of the terms of the respondent Government’s declaration and of the arrangements for ensuring compliance with the undertakings referred to therein; Decides to strike the application out of its list of cases in accordance with Article 37 § 1 (c) of the Convention.
