Nigmatullin împotriva Rusiei

Decizia nr. 28506/20 Ilvar Rimovich NIGMATULLIN împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 30 iunie 2022 în calitate de comitet compus din: Darian Pavli, președinte, Andreas Zünd, Mikhail Lobov, judecători și Viktoriya Maradudina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 16 mai 2020, După deliberare, decide după cum urmează: FACTE ȘI PROCEDURĂ Reclamantul, dl Ilvar Rimovich Nigmatullin, s-a născut în 1981. Plainele reclamantului în temeiul articolului 5 § 3 din Convenție privind lungimea excesivă a detenției preventive au fost comunicate guvernului rus („ Guvernul”). Prin scrisoarea din 16 iunie 2021, trimisă prin post înregistrat, reclamantul a fost solicitat să furnizeze Registrul informații referitoare la evoluții suplimentare în cazul său.

Reclamantul a fost, de asemenea, avertizat că Curtea poate elimina o cerere din lista sa de cazuri în care circumstanțele conduc la concluzia că nu intenționează să urmeze cererea. Cu toate acestea, nu a urmat niciun răspuns. DREPTUL Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea, în conformitate cu articolul (a) din Convenție, consideră că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din lista. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE

The applicant, Mr Ilvar Rimovich Nigmatullin, was born in 1981. The applicant’s complaints under Article 5 § 3 of the Convention concerning the excessive length of pre-trial detention were communicated to the Russian Government (“the Government”). By letter dated 16 June 2021, sent by registered post, the applicant was requested to provide the Registry with information concerning further developments in his case. The applicant was also warned that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that he does not intend to pursue the application. However, no response has followed. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 28 July 2022. Viktoriya Maradudina Darian Pavli Acting Deputy Registrar President
