Caz Data deciziei 11531/18+ Novica STANKOVI Comitetul de miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase, astfel cum apar în hotărârile Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), Având în vedere faptul că, în aceste cazuri, Curtea, după ce a luat notă oficială de soluțiile prietenoase atinse de Guvernul Statului pârât și de reclamanții și având în vedere că soluțiile s-au bazat pe respectarea drepturilor omului, astfel cum este definită în Convenția sau în Protocolurile sale, a hotărât să atace aceste cazuri din lista sa; După ce s-a convins că termenii soluțiilor prietenoase au fost executate de Guvernul Statului pârât, DECLAREA că și-a exercitat funcțiile în temeiul articolului 39 alineatul (4) din Convenție și DECIDE pentru a închide examinarea lor.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in these cases the Court, having taken formal note of the friendly settlements reached by the government of the respondent State and the applicants and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided to strike these cases from its list;

Having satisfied itself that the terms of the friendly settlements were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
