Ahmadli și alții împotriva Azerbaidjanului

Prima secțiune decizia nr. 4621/19 Ramin AHMADLI împotriva Azerbaidjanului și a altor 3 cereri (a se vedea tabelul apendice) Curtea Europeană a Drepturilor Omului (prima secțiune), care așezează la 29 iunie 2023 ca comitet compus din: Alena Poláčková , Președintele Gilberto Felici , Raffaele Sabato , judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazurilor, după deliberare, hotărăsc după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților și reprezentanților acestora este prezentată în tabelul adăugat.

În temeiul articolului 11 din Convenție, reclamațiile reclamanților privind măsurile ilegale sau disproporționate împotriva organizatorilor și a participanților la adunări publice au fost comunicate guvernului azerigian („Guvernului”). De asemenea, celelalte plângeri ale reclamanților pe baza aceleași fapte au fost comunicate în temeiul articolului 6 din Convenție, având în vedere jurisprudența relevantă bine stabilită a Curții. În cererea nr. 1165/22, plângerea reclamantului pe baza aceleași fapte a fost comunicată și în temeiul articolului 5 din Convenție, având în vedere jurisprudența relevantă bine stabilită a Curții. Curtea a primit declarațiile prietenoase, semnate de părți, în temeiul cărora reclamanții au convenit să renunțe la orice nouă afirmații împotriva Azerbaidjanului în ceea ce privește faptele care dau naștere la aceste cereri, sub rezerva unei angajamente ale Guvernului de a le plăti sumele detaliate în tabelul anexat.

Aceste sume vor fi convertite în moneda statului interesat la rata aplicabilă la data plății și vor fi plătite în termen de trei luni de la data notificării hotărârii Curții. A menționat o perioadă de trei luni, guvernul se angajează să le plătească dobânzi simple, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de împrumutare a Băncii Centrale Europene în timpul perioadei implicite plus trei puncte procentuale. Plata va constitui rezoluția finală a cazurilor. Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Curtea ia act de soluționarea prietenoasă achiziționată între părți. Este satisfăcut că soluționarea se bazează pe respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, și nu găsește motive pentru a justifica examinarea continuă a cererilor.

Având în vedere cele de mai sus, este necesar să se scoată cazurile din listă. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; decide să scoată cererile din lista sa de cazuri în conformitate cu art. 39 din Convenție.

DECISION Application no. 4621/19 Ramin AHMADLI against Azerbaijan and 3 other applications (see appended table) The European Court of Human Rights (First Section), sitting on 29 June 2023 as a Committee composed of: Alena Poláčková , President , Gilberto Felici, Raffaele Sabato , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above applications lodged on the various dates indicated in the appended table, Having regard to the formal declarations accepting a friendly settlement of the cases, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of applicants and their representatives is set out in the appended table. The applicants’ complaints under Article 11 of the Convention concerning the unlawful or disproportionate measures against organisers and participants of public assemblies were communicated to the Azerbaijani Government (“the Government”). The applicants’ other complaints based on the same facts were also communicated under Article 6 of the Convention, given the relevant well-established case-law of the Court. In application no. 1165/22, the applicant’s complaint based on the same facts were also communicated under Article 5 of the Convention, given the relevant well-established case ‑ law of the Court.

The Court received the friendly-settlement declarations, signed by the parties, under which the applicants agreed to waive any further claims against Azerbaijan in respect of the facts giving rise to these applications, subject to an undertaking by the Government to pay them the amounts detailed in the appended table. These amounts will be converted into the currency of the respondent State at the rate applicable on the date of payment, and will be payable within three months from the date of notification of the Court’s decision. In the event of failure to pay these amounts within the above ‑ mentioned three-month period, the Government undertake to pay simple interest on them, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.

The payment will constitute the final resolution of the cases. THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify a continued examination of the applications. In view of the above, it is appropriate to strike the cases out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases in accordance with Article 39 of the Convention.
