PRIMEA SECȚIUNE DECIZIE Nr. 20792/21 Krzysztof PUCHALSKI împotriva Poloniei Curții Europene a Drepturilor Omului (prima secțiune), care a stat la 9 noiembrie 2023 în calitate de comitet compus din: Lṣtif Hüseynov , Președintele Krzysztof Wojtyczek, Ivana Jelić , judecători și Viktoriya Maradudina, judecători adjuncți ai secțiunii interioare, având în vedere cererea depusă la 9 aprilie 2021, După deliberare, decide după cum urmează: FACTE ȘI PROCEDURĂ Dl Krzysztof Puchalski, reclamantul, s-a născut în 1973. Plângerile reclamantului în temeiul articolului 5 § 3 din Convenție privind durata excesivă a detenției preventive au fost comunicate guvernului polonez („Guvernului”), care a prezentat observații cu privire la admisibilitatea și meritul.

Observațiile au fost transmise reclamantului, care a fost invitat să-și prezinte propriile observații. Nu s-a primit niciun răspuns la scrisoarea Registrului. Prin scrisoarea din 13 ianuarie 2023, trimisă prin post înregistrat, reclamantul a fost notificat că perioada permisă de prezentare a observațiilor sale s-a expirat la 24 noiembrie 2022 și că nu s-a solicitat prelungirea timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să continue cererea. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii.

În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea decide, în unanimitate, să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE

The applicant, Mr Krzysztof Puchalski, was born in 1973. The applicant’s complaints under Article 5 § 3 of the Convention concerning the excessive length of pre-trial detention were communicated to the Polish Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit his own observations. No reply was received to the Registry’s letter. By letter dated 13 January 2023, sent by registered post, the applicant was notified that the period allowed for submission of his observations had expired on 24 November 2022 and that no extension of time had been requested. The applicant’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application.

No response from the applicant has been received. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
