PRIMEI DECIZIE DE SECȚIUNE No. 43691/18 A.W. împotriva Poloniei Curții Europene a Drepturilor Omului (prima secțiune), care așezează la 15 februarie 2024 în calitate de comitet compus din: Péter Paczolay , Președintele Gilberto Felici, Raffaele Sabato , judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 3 septembrie 2018, Având în vedere decizia de a acorda reclamantului anonimat, în conformitate cu art. 47 § 4 din Regulamentul Curții, după ce a deliberat, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl. A. W., reclamantul s-a născut în 1985. Denumirea reclamantului în temeiul articolului 8 din Convenție privind refuzul de a-i acorda permisiunea compasivă de a participa la o înmormântare a fost comunicată guvernului polonez („Guvernului”), care a prezentat observații cu privire la admisibilitatea și meritul. Observațiile au fost transmise reclamantului, care a fost invitat să-și prezinte propriile observații. Prin scrisoarea din 28 noiembrie 2023, trimisă de post înregistrat, reclamantul a fost notificat că perioada permisă pentru prezentarea observațiilor sale s-a expirat la 15 septembrie 2022 și că nu a fost solicitată prelungire a timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să continue cererea. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea decide, în unanimitate, să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE
The applicant, Mr A. W., was born in 1985.
The applicant’s complaint under Article 8 of the Convention concerning the refusal to grant him compassionate leave to attend a funeral was communicated to the Polish Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit his own observations. No reply was received to the Registry’s letter.
By letter dated 28 November 2023, sent by registered post, the applicant was notified that the period allowed for submission of his observations
had expired on 15 September 2022 and that no extension of time had been requested. The applicant’s attention was drawn to Article
37
§
1
(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicant did not claim that letter, and no response has been received.
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article
37
§
1
(a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
