CASE OF YILMAZ AGAINST AUSTRIA

Rezoluția CM/ResDH(2011)90 [1] Execuția hotărârii Curții Europene a Drepturilor Omului Yilmaz împotriva Austriai (Declarația nr. 14715/09, hotărârea din 30/09/2010) Comitetul miniștrilor, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor soluții prietenoase așa cum apar în hotărârile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”); având în vedere că, în acest caz, Curtea a luat notă oficială de soluționare prietenoasă atinsă de Guvernul Statului pârât și de reclamant, și a fost mulțumit că decontarea se bazează pe respectarea drepturilor omului astfel cum este definită în Convenția sau în Protocolul său, a hotărât, în unanimitate, să încheie acest caz din listă; având în vedere că termenii de închidere amicală au fost executați de statul pârât, DECLARES că a exercitat funcțiile sale în temeiul articolului 39 alineatul (4) din Convenția și DECIDES să încheie. Execution of the decision of the European Court of Human Rights

Yilmaz against Austria

(Application No. 14715/09, decision of 30/09/2010)

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”);

Considering that in this case the Court, having taken formal note of friendly settlement reached by the government of the respondent state and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided, unanimously, to strike this case out of its list;

Having satisfied itself that the terms of the friendly-settlement were executed by the respondent state,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
