Huseynov împotriva Azerbaidjanului

Primă secțiune decizia nr. 32457/18 Ali HUSEYNOV împotriva Azerbaidjanului (a se vedea tabelul apendice) Curtea Europeană a Drepturilor Omului (prima secțiune), care așeză la 18 aprilie 2024 în calitate de comitet compus din: Péter Paczolay , Președintele Gilberto Felici, Raffaele Sabato , judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 25 iunie 2018, Având în vedere declarațiile oficiale care acceptă o soluționare prietenoasă a cazului, după deliberare, hotărăsc după cum urmează: FACTE ȘI PROCEDIU Detaliile reclamantului sunt prezentate în tabelul anexat. Reclamantul a fost reprezentat de dna Z. Sadigova (Zakaryayeva), avocat practicant în Baku.

Plângerile reclamantului în temeiul articolelor 3 și 13 din Convenție privind presupusele maltraturi au fost comunicate guvernului azerbaigian („Guvernul”). Curtea a primit declarațiile prietenoase, semnate de părți, în temeiul căreia reclamantul a acceptat să renunțe la orice nouă afirmații împotriva Azerbaidjanului în ceea ce privește faptele care dau naștere la această cerere, sub rezerva unei angajamente ale Guvernului de a-i plăti sumele detaliate în tabelul anexat. Aceste sume vor fi convertite în moneda statului interesat la rata aplicabilă la data plății și vor fi plătite în termen de trei luni de la data notificării hotărârii Curții. A menționat o perioadă de trei luni, guvernul se angajează să le plătească dobânzi simple, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de împrumutare a Băncii Centrale Europene în timpul perioadei implicite plus trei puncte procentuale.

Plata va constitui rezoluția finală a cazului. Curtea ia act de soluționarea prietenoasă atinsă între părți și este convinsă că soluționarea se bazează pe respectul drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, și nu găsește motive pentru a justifica o examinare continuă a cererii. Având în vedere cele de mai sus, este necesar să se scoată cazul din listă. Din aceste motive, Curtea, în unanimitate, Decide să elimine aplicarea din lista de cazuri în conformitate cu art. 39 din Convenție.

FACTS AND PROCEDURE

The applicant’s details are set out in the appended table. The applicant was represented by Ms Z. Sadigova (Zakaryayeva), a lawyer practising in Baku. The applicant’s complaints under Articles 3 and 13 of the Convention concerning the alleged ill-treatment were communicated to the Azerbaijani Government (“the Government”). The Court received the friendly-settlement declarations, signed by the parties, under which the applicant agreed to waive any further claims against Azerbaijan in respect of the facts giving rise to this application, subject to an undertaking by the Government to pay him the amounts detailed in the appended table. These amounts will be converted into the currency of the respondent State at the rate applicable on the date of payment, and will be payable within three months from the date of notification of the Court’s decision.

In the event of failure to pay these amounts within the above ‑ mentioned three-month period, the Government undertake to pay simple interest on them, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The payment will constitute the final resolution of the case. THE LAW The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify a continued examination of the application. In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases in accordance with Article 39 of the Convention.
