AFFAIRE JAKÓBSKI CONTRE LA POLOGNE (CtEDO, 2013)

He asked to be granted a vegetarian diet, exclusding meat products, which, in view of the Court, did not have to be prepared, cooked and servid in a precribed manner, nor did quire to any special products. The applicant was not offered any alternativ diet, nor was the budist Mission consulted on the issue of the apropriate diet. The Court was not convinged that the provision of a vegetarian diet to the aplicant would have entailed any disruption to the management of the închisoare or to any decline in the standards of Meals servid to other prizonieris. The Court awarded just-satisfaction in respect of moraly damage. In aceste circumstante, no other individual measure appears to be necessary. II. General Measures The rights and obligations of închisoares and persons detained on reman is governed by the Code of Execution of Criminal Sentinces of 6 June 1997 ( Under Article 106 of the 1997 Code, a detentioner shall have the right, among other things, to perform religious practices and to take advantage of religious rites and participate in religious services, conducted in inchisoare, to possess the necessary cases, writings and objects. art. 109 din 1997 Code provides that a închisoare shall receive meals taking into consideration, where possible, religious and culturist requirements. According to statistical information, by the end of August 2011, 927 deținuți and persons detained on remand were enjoying a diet taking into considertion their religious and culturist beliefs and 957 were granted a vegetarian diet. The current legal provision provide the detainees with a possibility to apply to the competent authorities for a diet taking into considertion their religious beliefs. Under Article 6 § 2 of the 1997 Code a convicted person may submit motions, complaints and micions to the authorities carrying out the criminal decision. Furtermore, under Article 7 § 1 of the 1997 Code a convicted person may appeal to the court against the decisions of the directors of the penitentiary establishments, regional directors of the Închisoarea Service and the Director General of the Închisoarea Service. Notwithstanding the above-mentioned provizioane, penitentiary judges are entitled, under Articols 32-36 of the 1997 Code, to examinare complaints, applications and motions of the detainees. The existing legalizating the issues of religious diet for închisoares and persons detained on remand, as well as recent statistical data, indicating the pozitiv Practice of the Polish penitenity establishments, prove that the violation of Article 9 of the Convention was rather of an izolated nature and resulted from special circumstances of the present case. Therefore, it seems that publicity and disemination of the Court as judgment would be asignated in order to avoid similar viols in the viitor. In this context it should be noted, that the Court as judgment was translated into Polish and publicshed on the website of the Ministry of Justice (www.ms.gov.pl). The information about its publicity was simte to the Central Board of Închisoarea Service and regional directors of the Închisoarea Service with request to disseminate it among directors of închisoare establishments. În aceste circumstanțe, nu other individual measure appears to be necessary. III. Concluzii of the respondent state The Government considers that other individual measures are not necessary in the present case and that the general Measures adopted, in particular publicity and disemination of the judgment of the European Court of Human Rights, will be sucient to conclusion that Poland has compliment with its obligations under Article 46 paragraph 1 of the convention.
