Cazul de la decizia 16666/09 Ruslan ALIYEV 06/05/2014 (Adoptat de Comitetul de Miniștri la 10 septembrie 2015 la 1234-a ședință a Deputaților Miniștrilor) Comitetul de Miniștri, în conformitate cu art. 39, punctul 4 din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor aranjamente prietenoase după cum apar în hotărârile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), Având în vedere că, în acest caz, Curtea a luat notă oficială de aranjamentul prietenos atins de Guvernul Statului pârât și de reclamant, și a fost convinsă că încheierea s-a bazat pe respectarea drepturilor omului astfel cum este definită în Convenția sau în protocolul său, a hotărât din lista sa.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in this case the Court, having taken formal note of the friendly settlement reached by the government of the respondent State and the applicant, and having been satisfied that the settlement was based on respect for human rights as defined in the Convention or its Protocols, decided to strike this case from its list;

Having satisfied itself that the terms of the friendly settlement were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close its examination.
