Rezoluția ResDH(2005)48 privind hotărârile Curții Europene a Drepturilor Omului din 28 martie 2002 (finală la 28 iunie 2002) în 4 cazuri împotriva Italiei (a se vedea apendicele) referitoare la lungimea excesivă a procedurilor privind drepturile și obligațiile civile în fața Curții de Audit (aprobată de Comitetul de Miniștri la 21 iunie 2005, la a 928-a ședință a Deputaților Miniștrilor) Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, astfel cum a fost modificat prin Protocolul nr. 11 (denumit în continuare „Convenția”), având în vedere hotărârile Curții Europene a Drepturilor Omului în cele patru cazuri ale căror detalii figurează în apendicele prezentei rezoluții, eliberate la 28 martie 2002 și transmise Comitetului de Miniștri odată ce au devenit definitive în temeiul articolelor 44 și 46 din Convenție; reamintind că cazurile provenite din cereri împotriva Italiei, depuse între 7 octombrie 1996 și 16 februarie 1999 cu Comisia Europeană a Drepturilor Omului în temeiul articolului 25 din Convenție sau cu Curtea Europeană a Drepturilor Omului în temeiul articolului 34 din Convenție de către mai mulți resortisanți italiani, și că Curtea a declarat admisibile plângerile legate de lungimea excesivă a anumitor proceduri privind drepturile și obligațiile civile în fața Curții de Audit;
reclamanții din cauza Amici și Manna au renunțat la plata dobânzilor nejustificate și nu au fost necesare alte măsuri în prezent pentru a se conforma hotărârii Curții, Declarații, după examinarea informațiilor furnizate de Guvernul Italiei, că aceasta și-a exercitat funcțiile în temeiul articolului 46 alineatul (2) din convenție în aceste cazuri. the government of the respondent state had paid the applicants the sums provided for in the judgments of 28 March 2002, the applicants in the Amici and Manna cases having waived payment of default interest, and that no other measure was required in the present cases to conform to the Court's judgment, Declares, after having examined the information supplied by the Government of Italy, that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases.
