Rezoluția CM/ResDH(2013)98 Kashavelov împotriva Bulgariei Executarea hotărârii Curții Europene a Drepturilor Omului (Recuperarea nr. 891/05, Hotărârea din 20/01/2011, definitivă la 20/04/2011) (adoptată de Comitetul de Miniștri la 6 iunie 2013 în cadrul celei de a 1172-a ședințe a delegaților miniștrilor) Comitetul miniștrilor, în temeiul articolului 46 alineatul (2) din Convenția pentru apărarea drepturilor omului și a libertăților fundamentale, care prevede ca Comitetul să supravegheze executarea hotărârilor definitive ale Curții Europene a Drepturilor Omului (denumite în continuare "convenția" și "Curtea"), Având în vedere hotărârea definitivă care a fost transmisă de Curte Comitetului în cauza de mai sus și încălcările constatate reamintind obligația statului pârât, în temeiul articolului 46 alineatul (1) (1) din Convenție, să se conformeze hotărârilor definitive în litigiile la care este parte și că această obligație implică, pe lângă plata satisfacției echitabile acordate de Curte, adoptarea de către autoritățile din statul membru în cauză, dacă este necesar de măsuri individuale pentru a pune capăt încălcărilor constatate și pentru a elimina consecințele acestora, în măsura posibilului de către Restitutio in integrum de măsuri generale de prevenire a unor încălcări similare ; Am invitat guvernul statului pârât să informeze Comitetul cu privire la măsurile luate pentru a se conforma obligației După examinarea bilanțului de acțiune furnizat de guvern care indică măsurile adoptate în vederea executării hotărârii judecătorești, inclusiv informațiile furnizate în ceea ce privește plata satisfacției echitabile acordate de Curte (a se vedea documentul DH-DD(2013)147 [1] FIȘĂ că au fost adoptate toate măsurile prevăzute la art. 46 alineatul (1); DECLAMENTUL PE CARE își îndeplinește funcțiile în temeiul art. 46 alin. BULGARIA Application no. 891/05 Judgment of 20 January 2011 Final on 20 April 2011 THE FACTS The case raports to the systematic handcuffing of the applicant when taken out of his cell (violation of art. 3), excesiv length of judicial procesedings against him (violation of art. 6 alin. (1) și lack of an efectiv remedy to challenge the excesiv length of criminal proceedings (violation of Art. 13 in conjunction with Art. 6). He keeps his distance from everyone and everything. Mr. Kashavelov shows extrem hostility towards the judicial and executive powers. El încă nu a acceptat verdictul și nu a fost condamnat, cu o fixare pentru a dovedi că a fost condamnat. He is disparaging, incredulous and ostil to both the entreprisees and other închisoares. His irascibility, reductance to accept somebody elseiss available, rules and restrictions, his acumulated hatred and proverbial crudity make hym unpredictable and prone to revege any cost. El este unable to dissard pressure and thus disperses agresiune inadequately. Any attempt for a contact by the administration is privid by el as ostil and he blocks it. Conferning Mr. Kashavelov.s atitudine to other inmates, relationships within his group are based on acts of verbal and fizical agresion His contacts with other închisoares are very limited chause of his argouse and imperious behaviour and thing towards them. Dl Kashavelov permanently demonstrates hostility to the administrations officials. He is presposed to acumulatate enormous amounts of tensiune which is usually diluted through verbal threats for assaults and fizical distrugătion of the members of the închisoare stuff whom he has to commicate with. Since the beginning of 2012 up to the present moment Dl Kashavelov refuzs to uses right to outdoors stay. He has not expresed a dori to make telefon calls aswell. behaviour, breaches of the discipline and missdemeanours Dl Kashavelov has been administrativly pedepseshed twice during during his imprisonment (în 2001 și 2005), unce for threats against the supervizory and security staff and once for fizical assaint against another închisoare. Since he was informad of his final verdict in November 2004 are opozas to any attempt for contact make by the administration and social workers. The last identified case is from 09.02.2012 when the închisoare psihologist Mr. Kurtev tried to conducta a miting with the detention who responsed with verbal agresion. An identital case was registered on 08.06.2011, when he was send by a chaniiff with documents ordering to pay to the compens to the relative of the victims of his infractions. Mr. Kashavelov fell into emotional arous and treatened the SAEWS inspector and the închisoare administration with an assault. Information on the number and frequency of the planned and extraordinary meetings between Mr. Kashavelov and SAEWS offiers Acording to the Internal Rules for application of a System for Risk Assessment on Offenders Serving Aplicabil in the penitentiary institutions in Bulgaria and the current Practice application the assessment reports and the plans for the execution of the sentinces and individual measures to be taken priving the inmates are applied at least once a year. In case the închisoare has higher value of recedivism risk or otherwise represents pericol to the public, assessments are make at least every 6 months. These rules are applicable for the case of the aplicant and even sometimes assessment is make at shorter intervals. Mai mult, in his order of 18.05.2012, the governor informated that he should receive reports on the închisoare behaviour and on his situation on a monthly bazis. In the applicicants case the standard assessment of the risk of rectivism is made mortly on the bazis of the available documentation, side observations and reports and information provided by the security stuff due to the reductance of the detention to conduct a conversion with a SAEWS inspector and a psihologist. It has average value of 65 de puncte. Thus the assessment of the risk of harm to the public, inchisoare staff and other inmates is with high value that remain unchangeed in time. There is lack of motivation and desire for changes. The prizonier has never sver ssychiatric or psihological help. As mentioned above due to thefact that el refuzs to comunicate and the high risk of incidents upon direct contacts Mr. Kashavelov is mainly subject to daily observation by the SAEWS inspector, the psihologist and the security stuff. These observations are regulally reported to the governor and are taken in considetion when application individual securitying comesures on the aplicant. The last assessment reports of the individual risk of the aplicant were made on 10 February 2012 and 2 August 2012 by the SAEWS inspector supervising his group. No improvement in his personity or the risk rates was observad and the inspector suggested the continuation of the use of enhanced precautionary measures upon convoying Mr. Kashavelov out of the high security zone. on the bazis of the report of 10 February 2012 the head of Sofia pușcărie issued the order No P-12/13.02.2012 establishing the individual Measures referent Mr. Kashavelov. A new order providing for similar measures priving the aplicant was issued on 18.05.2012. The two document have been simte to the Department for the Execution of Judgments of the Court on 17.02.2012 and on 11.11.10.2012 Information about the intervals at which the measures impuned on the aplicant are reviewed by the Head of the Sofia Prison. It should be noted that this particular case is closely observad by both the governor and the General Director of GDEP. As mentioned in the previous punct reassessment of the applicicants behaviour is performed at least every șase months and the head of the închisoare is immediately acquainted with it. The domestic law and Practice do not obligation the head of the închisoare to confirm or invalidate his initial decision following the periodical assessments of the it. Însă, the management of the închisoare will amend the order upon any signs of pozitiv development in Mr. Kashavelovers behaviour. when issuening orders with vizion to security measures the governor acts in the conditions of operative independence, însă he is obligad to take into account any and allfacts and Circumstances of the case, including the assessment of the închisoares bejaviour. Furtermore it should be noted that the aplicant has at his disposal all the remedies mentioned in pct. 5 below. Remedies available to the aplicant to contemplant the security measures taken against him. Dl Kashavelov was expressly notificăd for the Orders of 13.02.2012 and 18.05.2012 [5] upon their provenance but he did not take action to appeal against it within the time-limit set in the Administrative Procese Code (heeafter Chapter VI of APC (art. 81) states that the individual administrative act (the Order in this case) may be contestăd in front of the higher administrativ organical (i.e. the Director General of EPGD) and then in front of the competent administrative scurt, in this case the Sofia Administrative Court. Its first-instance scurt decision may be appealed within 14 days in front of the Supreme Administrative Court as a cassation instance. Mai mult, as the Order is an individual administrative act, the aplicant may at any time request that a new order be issued by the head of the închisoare and may contember either his tacit or expres refuzal to do so. According to APC the express or tacit remuner to finis an administrativ act is subject to juridic review before the administrative scurts. The contemplation of tacit remunchals is regulated in Article 149(2) of APC [6] The Bulgarian authorities do not have knowledge of case-law requests by închisoares to issue a new order regarding the use of security measures, însă they consider that this legal avenue can be used in such situations. Furtermore, it should be mentioned that Mr Kashavelov is entitled to submit complaints with vizion to his regime and conditions for detention to the supervising prosecutor as well as to the General Director of GDEP to the Ministry of Justice (under art.90 (1) of EPDCA). By now he has not used any of these options. Each case of use of ausiliary means is considered with the individual features of the respective închisoare, his or her behaviour and the assessment of the risk to harm others (for the frequency of assessments Please see punctul 3, last paragraph of the individual measures above). The use of rutina handcuffing in Bulgarian detention facilities is not a common Practice and all such cases are based on particularfacts and circumstances which necessitate the taking of aditiv security measures in order to preperve the life and health of others. In its comentations on the CPT report Bulgaria noted that in this izolated case there was sucient data that the închisoareer behavedly behaved violently, booth towards închisoares and staff, each time impulsively, unxpectedly, and brutally In any case we would like to underline that CPT The Supreme Administrative Court (inclusiv SAC.) was informed about the findings in the Kashavelov. It is a well-estblished Practice of SAC to conform its final decisions to the Strasburg Court case-law. Another claim from the same închisoare was rejected, but the appeal is currenting before SAC. [10] remedies which could be used to contestation handcuffing de rutină Remedii available to other life-sentenced inchisoares are the same as remedies available to the aplicant. Prin urmare, the domestic law provides for a set of remedies which is sucient to address complaints privining rutina handcuffing. Additional general measures avut în vedere by the authorities As mentioned above a letter has been miros to GDEP with the findings of the Court under the case of Mr. Kashavelov. A similar notification was miros to SAC aswell. Out of hours, any such direction shall be given by the comanding officer of the on-duty unit.
